Whilst the primary and overriding duty of the Expert is to the judicial body to whom the evidence is given, the Expert must be able to effectively articulate the merits of his client's case in order to deliver a report that is clear, concise, factually correct, and able to withstand the robust interrogation of the adversarial process.
A key element of the Experts remit is to be able to work effectively with others, whether it be with witnesses, counsel, solicitors or other legal advisors to ensure that the quantum evidence does not stand in isolation, but fully reflects the facts of the case and the impact of programming and engineering implications.
Any form of adversarial process is capable of generating significant costs, and increasing business risk. We strongly advocate achieving the maximum level of agreement between the parties as the issues clarify. Whether through a Scott Schedule process or negotiated compromise, we believe it is part of the Experts role to advise his client where costs can be mitigated.
