Adjudication

All forms of construction contract now provide for an adjudication process, with a referal now a statutory pre-requisite to entering any higher form of dispute resolution.

The process is very prescriptive as to timing which means that the referring party must be thorough in its preparation, and the responding party reactive to the notice.  As a result, an unintended side effect of the process is that it can be extremely disruptive to the parties, particularly the respondent.

Such circumstances lend themselves to benefits of external support, and at DGA we can use our extensive collective knowledge of the dispute resolution process.  We can:

assist in the preparation of referals and responses

assemble case documentation

prepare evaluations

advise of applications to enforce decisions

advise on challenges to decisions.
